Please read these Terms and Conditions (“Terms”) carefully before using the services of Kova Cabinets, Inc. (“Kova Cabinets,” “we,” or “us”) as a custom cabinets manufacturer. These Terms govern your use of our services and the purchase and sale of our custom cabinets. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

Services

1.1 Custom Cabinets Manufacturing: Kova Cabinets specializes in the manufacturing of custom cabinets for residential and commercial use. We provide design, fabrication, and installation services to meet our customers’ unique specifications and requirements.

1.2 Estimates and Quotes: We offer free estimates and quotes for custom cabinet projects based on the information provided by the customer. These estimates are subject to change once an on-site assessment is conducted. The final price for the custom cabinets will be provided in a formal quote.

Orders and Payments

2.1 Order Placement: To initiate an order, customers must provide detailed specifications, measurements, and any other relevant information required for the custom cabinets. Orders can be placed in person, over the phone, or through our website.

2.2 Pricing and Payment: The pricing for custom cabinets is provided in the formal quote. All prices are in the local currency and are exclusive of applicable taxes, fees, and shipping costs. Deposit payments must be made in full before the manufacturing process begins. We accept various payment methods, including credit/debit cards, bank transfers, or other mutually agreed-upon methods.

2.3 Order Changes and Cancellations: Any changes or cancellations to an order must be communicated to us in writing within a reasonable time frame. We will make every effort to accommodate such requests, but we reserve the right to charge additional fees or withhold a portion of the payment for work already completed.

Manufacturing and Delivery

3.1 Manufacturing Process: Our custom cabinets are manufactured with meticulous attention to detail and craftsmanship. The manufacturing process may vary depending on the complexity of the project, but we strive to meet agreed-upon timelines and quality standards.

3.2 Delivery and Installation: We offer delivery and installation services for custom cabinets. The delivery schedule will be communicated to the customer, and any changes or delays will be promptly communicated as well. It is the customer’s responsibility to ensure the availability of the installation site and to prepare it accordingly.

Product Warranty

4.1 Limited Warranty: We stand behind the quality of our custom cabinets. We provide a limited warranty that covers manufacturing defects for a specified period. The warranty does not cover damage resulting from normal wear and tear, improper use, modifications, or accidents.

4.2 Warranty Claims: Any warranty claims must be made in writing and accompanied by supporting documentation. We reserve the right to inspect and assess the claimed defect before taking appropriate action, which may include repair or replacement of the affected cabinet(s).

Limitation of Liability

5.1 Exclusions: In no event shall Kova Cabinets be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services, including the purchase and installation of our custom cabinets.

5.2 Maximum Liability: Our liability for any direct damages shall be limited to the amount paid by the customer for the specific custom cabinet(s) giving rise to the claim.

Intellectual Property

6.1 Ownership: All intellectual property rights related to our services, including designs, drawings, specifications, and other materials, remain the exclusive property of Kova Cabinets or its licensors. Customers may not use, reproduce, modify, or distribute these materials without our prior written consent.

Governing Law and Dispute Resolution

7.1 Governing Law: These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of State of California.

7.2 Dispute Resolution: Any disputes or claims arising out of or in connection with these Terms shall be resolved through negotiation and, if necessary, through binding arbitration in accordance with the rules of State of California. The arbitration shall take place in Sacramento, California, and the language of the arbitration shall be English.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Amendments

We reserve the right to modify or amend these Terms at any time. The updated Terms will be posted on our website, and your continued use of our services after such changes constitutes your acceptance of the amended Terms.
